There can be only three explanations: One- He is mentally ill (my guess) , Two - He is under the control of someone in a higher office, or Three - Both.

Think about it, why would an Assistant District attorney (H. Johnson) ask a Judge to incarcerate someone for a misdemeanour crime, (Writing a comment on the internet) and let's not forget that the concept of due process is ("innocent until proven guilty) for the entire length of the trial, which usually takes a year.
